Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Rivermatics ("we," "us," "our") governing your use of the Rivermatics application and related services (the "App"). By accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes. You may not sell, sublicense, reverse engineer, or misuse the App or attempt to disrupt its operation. We may modify, suspend, or discontinue the App at any time without notice or liability.

2. Free / As Is

The App is provided free of charge. THE APP AND ALL DATA, FORECASTS, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, timely, secure, error-free, or that any data will be accurate or reliable.

3. No Reliance / Assumption of Risk

River, water, and weather data are inherently uncertain and may be delayed, incomplete, estimated, or incorrect. You assume all risk arising from your use of the App and any decisions you make based on it. You are solely responsible for your own safety and the safety of others, and for independently verifying conditions through official sources before engaging in any activity on or near water.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIVERMATICS AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (WHICH, FOR A FREE APP, IS $0) OR (B) USD $100. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

5. Indemnification

You agree to indemnify, defend, and hold harmless Rivermatics and its contributors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use or misuse of the App, your violation of these Terms, or your violation of any law or third-party rights.

6. Third-Party Data

The App relies on data from third-party sources (e.g., government agencies, weather providers). We do not control and are not responsible for the accuracy, availability, or content of third-party data, and your use of such data may be subject to the third parties' own terms.

7. Changes

We may update these Terms; material changes are indicated by updating the Effective date. Continued use after changes take effect constitutes acceptance.

8. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Disputes will be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction there.

9. Severability / Entire Agreement

If any provision is unenforceable, the rest remain in effect and the provision is modified to the minimum extent necessary. These Terms, with the Privacy Policy and Safety Disclaimer, are the entire agreement regarding the App.
